No, you won't have to be out on that date, but shortly thereafter. The amount of time you have depends on who buys the house. 99% of the time your mortgage holder buys the house and you will have time before they get it together and evict you. However, if an individual buys the house, you will probably have much less time. The laws in Texas state you must give the previous owner (you) a 3 day written notice to vacate. After that time, they have to go to the courthouse and file eviction proceedings. You will be served with a notice to vacate at the end of 10 days. At the end of the 10 days if you are still not out, you will be served again with a notice to be out in 5 days (usually). After those 5 days then you will be forcably removed from the premises. The constable will be there but the new owners will be the one actually putting your stuff on the street. So, depending on who buys the house and how long they take to serve you that 3 day notice, you could have no time at all, or as long as a month or so....it all depends.
