Once the property situation has been properly disposed of then you might consider taking civil action against the investor. Most important would be to re-read the terms of your agreement with the investor to make certain that you have grounds for filing suit.

An attorney would be best suited to assist you in this effort. Just don't allow yourself to be talked into filing bankruptcy unless it suits your ultimate goal.
