I am sure it varies from state to state but in our case (Pennsylvania) after the Chapter 13 was dismissed they had to refile and the Sherrifs sale was about 2-3 months after. Our county only does sales every other month so that might make a difference.
: I am in New Mexico, and my chapter 13 may be dismissed due to some unfortunate circumstances that kept me from making a couple of payments. My house was in foreclosure when I filed, a sale date had been been set, I filed only days before the sale date.
: My question is, at what point will they resume the foreclosure? Will they republish the sale information for the prior 4 weeks before the new sale date, or will the sale happen just days after receiving notice that my case was dismissed? I need to know so that I can make plans to move.
