Bankruptcy does funny things to a foreclosure sale date. Depending on whether or not the bank postponed the sale or suspended the sale persuant to the bankruptcy determines where they resume the foreclosure. I suggest you contact your attorney and ask him / her to petition for reconsideration / reduction of payments if it's not to late. How long ago did you stop making the trustee payments? You can email me the answer and I'll try to suggest some options for your situation if I can.

: I am in New Mexico, and my chapter 13 may be dismissed due to some unfortunate circumstances that kept me from making a couple of payments. My house was in foreclosure when I filed, a sale date had been been set, I filed only days before the sale date.

: My question is, at what point will they resume the foreclosure? Will they republish the sale information for the prior 4 weeks before the new sale date, or will the sale happen just days after receiving notice that my case was dismissed? I need to know so that I can make plans to move.

: Thanks in advance,

: Lori
