I will defer to a person that is more up to speed
on PA statue as to if the foreclosing entity had
to restart the foreclosure process when the stay
was lifted. For what you have posted, this appears
not to be the case. Thus the foreclosure picked up
where it left off, post stay, with an immediate sale.
If this is the case, then I would first ask the
question; is it worth the trouble of trying to get
this sale reversed. You are left with one of the
following:
- If there was no third party involvement at
auction, then you may petition the lender to
sell you the property.
- If there was third party involvement at auction
you may by the property from them a FMV.
- You might try to get a BNK trustee/judge to
reverse the sale. But this will be for their
benefit, not yours.
