Foreclosure in KY

My husband and I purchased our home 1.5 years ago. We are current on our payments and have never been late. We received 100% financing, so our mortgage includes about $5000 worth of closing costs. This is our first home loan. We currently owe $93,000 (the house appraised for $95000 2 years ago) We have been repeadtedly harrassed by my husband's ex-girlfriend. When I say harrassed (you have no idea how bad it is.) There have been assault charges filed, harrassment and stalking charges filed, but in KY women are seen more as the victim than men, so we have gotten no where in the court system. Basically, our only choice is to move somewhere where this woman will not be able to find us. We have a 10 month old child that I fear for her safety when this woman comes around (it really is that bad.) We have listed our house for sale last week, and our having to ask $99,900 (this will allow us to pay off the mortgage and pay the realtor commission.) I do not think the house will sell for this amount, as the houses in our neighborhood typically sell for about $89000.

The problem is that we have found a house for rent that we can afford and would really like to move on in. The owners have agreed to hold the house for us until June 1st. There is no guarantee that my house will sell before then. (We have not had the first person come and look at it.) I can not afford to keep paying a house payment as well as rent. Our house is in an ok neighborhood, but we could not rent it out for what our mortgage is. My mortgage payment is $830 a month, and the houses around us rent for about $700 - so renting it out is not an option. I just want it to go away - I dont want to live there anymore or be harrassed. I'm afraid that if we stay there any longer, the harrassment situation is only going to get worse. We have asked our local police dept to have extra patrols, but unless they see the criminal activity taking place, there is nothing they can do.

I have contacted my mortgage company to let them know that I can not continue to pay the mortgage payments. I do not want to have to worry about my wages being garnished because I have a small child to take care.

What are my options? I can not afford an attorney.
