: The problem is that we have found a house for rent that we can afford and would really like to move on in. The owners have agreed to hold the house for us until June 1st. There is no guarantee that my house will sell before then. (We have not had the first person come and look at it.) I can not afford to keep paying a house payment as well as rent. Our house is in an ok neighborhood, but we could not rent it out for what our mortgage is. My mortgage payment is $830 a month, and the houses around us rent for about $700 - so renting it out is not an option. I just want it to go away - I dont want to live there anymore or be harrassed. I'm afraid that if we stay there any longer, the harrassment situation is only going to get worse. We have asked our local police dept to have extra patrols, but unless they see the criminal activity taking place, there is nothing they can do.
: I have contacted my mortgage company to let them know that I can not continue to pay the mortgage payments. I do not want to have to worry about my wages being garnished because I have a small child to take care.

Normally the mortgage will come after a foreclosure on
a home and only if you owe more than the house is worth
will they come after the money owed. In most cases the
mortgage companies cannot come after the remainder of the money such as if you are still living in the home when the foreclosure is taking place. I guess this is the reason HUD tells everyone not to move out and stay in the home for free during the proceedings. Hope this helps. Free rent is better than paying for rent to the other party.
