Nancy, can you provide more information? Was the foreclosure process complete? Was your house sold on the steps of the courthouse? Was this real estate agent representing the bank? Were there witnesses that your property was taken? How did you get the Agent's name? Have you been to court or been served notices regarding your house? Were you still residing in the house at the time your things were taken? Not really relevant, but, what city in Texas was this in?

I am not a lawyer and can not give legal advice. I have had some experience with this though and can cite the relevant laws regarding abandoned property. What you need to do right now is to write down a chronology of relevant events. A detailed account of phone calls with dates, times, who you spoke to, and what was said needs to be made. You will need to send a certified mail w/ return receipt to the real estate agent and the bank regarding your property. There might be criminal laws that apply but the police will usually tell you this is a civil matter and dismiss your complaint without investigating it. Sometimes, the person responsible will deny having been involved after realizing the consequences, even after admitting to you the took them. Recording phone conversations is legal in Texas as long as one party to the conversation knows it is being recorded. I have even used it in small claims court.

: My personal belongings were not placed on the curb. They were taking directly out of my home onto a trailer as the broker told me. This was all done on Sat.and Sun. I called her first thing Monday morning as she told me it has been disposed of.
: I don't think this is true due to the Items that were taken. You don't throw away a motor cycle that runs, nor a washer and dryer that runs, nor a grandfather clock. She picked thru what she wanted and then "gave the rest of it to someone with a trailer. She made no attempt to contact me and yes she did not have my number. She talked to my neigbhors and they all had my number but she did not ask for that and of course the reason why was the gold mine she found. Now! what is my next step. I will call the court house first thing Monday morning but any other advise sure would help.
