Pre-auction

Hello,
I am a realtor in Colorado, and have a buyer who is in the process of buying a pre-auction forclosed home in CO. My question is...when is an auction fee instated? Is the auction fee instated when it goes to auction or when it is advertised as going to auction?
I would apreciate any feed back on this matter, thank you
