HOA foreclosure

Posted by willcmass on February 18, 2006 at 22:24:34:

I live in the state of TX. I just recently found out that due to my HOA not having my current address on file, I did not receive HOA due notices, subsequently my 2005-2006 HOA dues did not get paid on time. I only found out about this after I received a registered letter in the mail stating foreclosure proceeding on my home and property were starting. I contacted the HOA and they stated that I was liable for any/all dues, late charges and attorney fees. Can they take my home for a meer $310 dollars being late (I went ahead and paid the $310)? I feel like I'm being swindled. If I pay the rest of what they are asking ($941), does this guarantee that the foreclosure will stop? I'm also wondering if there is any recourse that can be taken since I did not receive any notices in the mail concerning dues and their due date (HOA was sending them to my former address). This has all just been a misunderstanding, I'm not trying nor never were trying to get out of paying the dues.
