I just recently found out that due to my HOA not having my current address on file, I did not receive HOA due notices, subsequently my 2005-2006 HOA dues did not get paid on time.

.....Unfortunately this occurs..it is incumbent upon you to keep them current.

I only found out about this after I received a registered letter in the mail stating foreclosure proceeding on my home and property were starting.

......You are lucky, I buy tax liens and face people all the time who have lost their property for the same reason.

I contacted the HOA and they stated that I was liable for any/all dues, late charges and attorney fees.

....Most HOA CC&R's Agreements state this.

Can they take my home for a meer $310 dollars being late (I went ahead and paid the $310)?

....YES, they can...see above.

I feel like I'm being swindled.

....Not really, stop and ask yourself whose fault is it that YOU did not keep them current.

If I pay the rest of what they are asking ($941), does this guarantee that the foreclosure will stop?

...Yes, it will stop the foreclosure. You should ask for and receive notification of this and an itemized billing of all that you pay.

I'm also wondering if there is any recourse that can be taken since I did not receive any notices in the mail concerning dues and their due date (HOA was sending them to my former address).

....Recourse again whom? The HOA was sending them to the address you gave them.

This has all just been a misunderstanding, I'm not trying nor never were trying to get out of paying the dues.

....Good, best to pay up, fess up, correct up, and MOVE ON.

PS: Watch out for that other guy!

Good Luck,
Bill H
