I have just purchased my parents' home because they were in jeopardy of being foreclosed. The account had just been turned over to mortgage company's attorneys. Two weeks ago I received a payoff figure assuming an April 30 closing. It specifically stated that the payoff figure was only until April 30 and attorneys fees may increase beyond that date. When my attorney requested confirmation of the payoff figure, the attorneys fees had been increased by $1700 for the same April 30 closing date. When I personally inquired from the attorneys why this was, the response I received was "the fees are in accordance with the Rules of Court." What Rule is this? Does anyone have the Statute or Rule for NJ regarding attorneys fees? My attorney attempted to negotiate with them, but they wouldn't budge because they knew we were backed against the wall because the closing had to take place yesterday. Is it possible to recover these costs?
