: I was served foreclosure papers on May 25, 2002, since that time I have continously tried to get some kind of response from the banks lawyers but to no avail. The mortgage is current, being paid by disability insurance that I carry on the mortgage, have proof that payments are current and being accepted by the bank. During this process the bank repossed my car because they held the title against the mortgage, the car was totally paid for. I have had to hire an attorney to try and get some kind of response from the lenders attorney so this could be taken care of, I dont like the foreclosure hanging over my head. My attorney has also tried on several occasions to get some kind of response, faxes, phone calls, registered letters etc. all to no avail. The last time I spoke with my attorney she suggested we file papers for a dismissal with the courts, that way they would have to answer us. My question is do I have any recourse in getting my lawyer fees back ($1000) and/or some kind of compensation for my car, and do I still have to pay the lenders attorney fees?

: PS. I live in Florida and cannot find any kind of specific laws regarding this, if anyone knows where I can go look please let me know.

To Debbie: File a complaint with the Federal Trade Commision. You can get the forms on-line. Be specific. Contact me anytime, if you wish.
