Sounds to me you have already tried a workout with the lender. I suggest you contact a real estate attorney and let him get involved. The bank can actually commence foreclosure proceeds when you are 30 days late; however, most lenders waite 90 days. It seems like you are willing to work out the problem you also might contact the lender's Loss Mitigation Office - sit down with them and negotiate how you are going to make up the back payments. I would like to know if I am 90 days past due on my house paymt, is this when they can start foreclosure on my home. I have not paid April, or May. My husband was laid off from his job and he now has a new job but they hold out a week 's check. We told our morgage company that we will be paying one full payment June3, and then another full payment June6th. The morgage company says no! They wanted the payment by the 30th of May. They say they will not accept my payments any date after the 30th of May. I have been told that we have to be in default of our loan for 90 days before the can even start forclosure. IS this true? We have not received anything by mail or certified yet. What right do I have and what exactly is the time frame and if they do start forclosure will they accept payments toward my home so I can keep my home? This is my first home and I am not loosing it!!!
