Regardless of whether your are in bankruptcy or not - tenants are obligated to pay the rent or be evicted. Because of the bankruptcy - rental payments should never be cashed by you but endorsed to the bankruptcy trustee with your case number. COMMENCE EVICTION PROCEEDINGS IMMEDIATELY!

WE OWN A DUPLEX IN CALIFORNIA AND THE TENANTS HAVE BEEN LIVING THERE RENT FREE SINCE 3/03 DUE TO THE FACT WE ARE IN BANKRUPTCY NOW. WE ARE UNABLE TO MAKE PAYMENTS ON THE PROPERTY. MY QUESTION IS CAN THE TENANTS TURN AROUND AND SUE US AFTER THE BANKRUPTCY FOR SOMETHING? LIKE EMOTINAL DAMAGE, NO MONEY TO MOVE CAUSE IT WAS SHORT NOTICE, ETC...
