            <description><![CDATA[ As I understand the situation, Wells Fargo is denying a loan modification based on the belief your father does not live there and he is the one who obtained the loan.  Copies of income taxes filed with the IRS and a current utility bill should provide that evidence.<br />
<br />
Short sale would require your father, assuming he's on title to the home, to list the property for sale with a real estate agent.<br />
<br />
If the property actually goes to auction you should figure on being out of the property around 30 days after the auction.  It could be later but that would be a &quot;safe&quot; timeframe.]]></description>

            <description><![CDATA[ They are to sell the house on the county courthouse steps on June 4.  Can I try to short-sale before at this point?  Do I have to contact a realator to do a short-sale?  (I think that is a yes but just checking)<br />

If it goes to the foreclosure date how long will I have to move out?  <br />
<br />
They are stating they will review more paperwork for underwriting so trying to continue to get more paperwork together for reveiw before June 4 ?<br />

            <description><![CDATA[ It was very late and I guess I didn't explain the situation very well.....All this late night worrying!<br />
But you are correct.  I did work out of the house to help with my mother during the day <br />
who was ill.  Therefore, I had the internet and phone in my name when I had the internet installed.  It has been explained to Wells Fargo and we are to send in things with his name on items (from the mail) to show he was recieving information at this address.  They are going to determine based on that.  He bought this house to be closer to town but kept his original home and family lives there.  There are some items that still has his name attached to that house because mail was never changed.  Items were just given to him if they came to that address by family.]]></description>

            <description><![CDATA[ I read more on the principle reduction program and it mentioned that loans backed by Fannie Mae are not qualified.  I believe my loan falls in that category.  I called last week and left a message with my loan manager at B of A, but no return call.  I just left another message today.  I also got a letter yesterday from B of A that my property has been referred to foreclosure.  What does that mean?  Is my property in foreclosure?  Or, are they getting ready?]]></description>

Did your Father actually live there?   If so, he must have had mail going there.  Do you have any kind of tax status in your state for owner occupants?<br />

And have you explained to Wells Fargo the situation?  <br />

            <description><![CDATA[ I agree with you, it is unlikely any such language &quot;stop paying whever you want&quot; would be found in the loan mod docs... but they could and probably do contain a defacto reaffirmation.  The Borrower seems convinced there is/was no reaffirmation so I was suggesting she have another set of eyes look it over.  Of the 100's of loan mod agreements I've reviewed I thought many were well written, but many were amateurishly cut, pasted, and full of holes.]]></description>

            <description><![CDATA[ ells Fargo denied our last request for a loan modification and set a sale date for June 4, they<br />

 denied stated could not prove residency on the house.  My father's home has my telephone number on the home phone bc I did Medical Transcription there qhile helping to look after my mother and since it was my business I listed the services in my name. His   namr was left on is house that he doesnt live in annymore.  Is there any chance Wells Fargo is going to let him keep this house and work out a load modification. The load was on an afjustable arm and the paymet is now exceeding the contract amt of 1057.  payment is now up to 1231.<br />

Any help would be appreciate,  Cant catch up,,,, We don't know what to do byt we dont[ want to lose this house]]></description>

            <description><![CDATA[ Indiana, as I understand it, is largely a judicial foreclosure state.  That means a foreclosure goes through the court system.  In normal times this can take 5-7 months and now with the courts backed up it would probably be longer.<br />
<br />
Foreclosure is not a quick process.  They won't be appearing to throw you out on the street any time soon.<br />
<br />
As NJ Dave suggested it won't hurt to see if the lender has additional options.  But you have already used most of them.  I also don't see a lot of hope in this situation.<br />

            <description><![CDATA[ Depends on the state.  In many states the lender does NOT have to show original paperwork but can produce copies.  This is the age of computers so much is now stored in a digital format.  The main thing with this &quot;foreclosure defense&quot; is that the party foreclosing being able to show it has that right.<br />
<br />
Again, we have a number of different interpretations on this.  You might want to contact local attorneys who work in this field.  Do not depend on national news stories for something like this.  And be careful of scams that promise the world.<br />
<br />
As you suggest, this is largely a stall tactic.  Lenders will keep coming after a delinquent borrower.  They may have to regroup but seldom are stopped.]]></description>

            <description><![CDATA[ Probably the simple way of looking at real estate taxes is that they stay with the house no matter who owns it.  If there is a foreclosure when the lender (or whoever) takes over the property, the taxes are there to be paid by the new owner.  In the case of a lender who then wants to sell the property, they must pay all taxes due until date of closing in order to give clear title to a buyer.<br />
<br />
Compare this to the typical utility bill that will stay with/follow the user. Each state may be different on what stays with a property and what doesn't.  Here is Minnesota, city water and sewer bills stay with the house just like real estate taxes but gas and electric, which are normally done by private providers, follow the user.]]></description>

            <description><![CDATA[ I've read a large number of articles where people are asking the lender to produce the original paperwork for the mortgages, and it's stopping the banks, at least for a while.  Basically you are telling the bank to prove that you are in fact the lender who holds my mortgage.  My question is, I know that this can't stop the bank forever, but if the judge rules against the bank, or they are forced to withdraw the suit, how can they proceed any further?]]></description>

            <description><![CDATA[ Can't say for sure in your state. But, in my experience if you did not pay the back taxes the lender may have pid them. I know here in Florida they typically do that to protect their interests. They don't want someone to buy a tax certificate and have a stake in the property. Just like here they also will place lender paid insurance if you lapse. However, those expenses are added to your total owed at the time of the Summary Judgememt at forclosure time.]]></description>

            <description><![CDATA[ IMHO, there would be no need to participate in a short sale unless you want to expose yourself to unnecessary inconvenience.  The lender will continue to pursue foreclosure to force the sale of the property. As stated, it could take a year from when you were first served with the foreclosure summons.   You could request another workout, you could offer a deed in lieu of foreclosure in exchange for relocation cash, or you could offer a deed in lieu of foreclosure and request as a condition of the DIL you be offered a lease at market rent. <br />

If you care to send (FAX/scan) to me the loan mod agreement, I would review it with respect to the &quot;reaffirmation&quot; language.  If I have any question as to its meaning, I could have our in house counsel (my daughter) give it a look, too]]></description>

When we did the loan modification my husband said he made sure that by signing we werent making ourselves liable for the debt. So it appears we are not liable for the debt. I would consult with a local housing counselor or attorney and ask how long the process takes.  I'd confirm the bankruptcy discharge and status of the mortgage loan before you did anything else.]]></description>

They did reopen our case and are asking for a bunch of documentation. We need to return to them for underwriters to look at and see if there is anything they can do. She said it takes them 30 days to process it. They said if anything is going to happen then it needs to happen pretty fast. So that means we might hear back sometime in June. <br />

I am not sure whether to sit tight or start looking.....or to move out and put the house up and get a possible short sale??<br />

Many lawyers oppose the idea of reaffirmation agreements especially if the mortgagee continues to accept monthly payments without a formal reaffirmation in place. If the mortgage loan debt was discharged in the bankruptcy it is possible you reaffirmed the mortgage debt when you entered into a loan modification agreement, I don't know.  I would doublecheck the Chapter 7 discharge to see if, in fact, the mortgage debt was discharged.  Then, carefully read the loan modification agreement.<br />
<br />
There is no harm in asking the mortgagee for another workout, but it is under no obligation to offer additional relief.  Don't agree to something which is unrealistic.<br />
<br />
I would not be too optimistic about keeping the house.]]></description>

            <description><![CDATA[ We filed chapter 7 bankruptcy in January of 2008. We told our attorney at the time that we intended on reaffirming and staying in our house. As far as we knew at the time, this is what took place. But a few months later we found out that the reaffirmation never happened; we never signed paperwork for this. We were current on our mortgage at the time of the bankruptcy. We filed because of personal debt do to my husband's job loss. So we continued to pay our mortgage even after the bankruptcy. As I understand it (and I am not sure I do), because there was no reaffirmation, we were/are not liable for the debt on this house even though our name appears on the mortgage. So we continued to pay them but got in trouble a year later and stopped making payments. They did a loan modification for us which was done sometime in 2009. This reduced the interest rate and our monthly payment. And now, once again, we started having financial problems and got behind on payments. My house was filed in March for foreclosure.<br />

Every since my husband's job loss that led us to bankruptcy, we have not been able to reestablish our income that we had before. Our house payment from the loan modification is as low as what you would pay for an apartment or a rental. We live in a modest 4bdrm, 2000 sq ft home suitable for a family of 7. I have 5 children. My husband's work (2 jobs) has not been completely steady; we learned about 6 mos ago of a 30% decrease in his pay. His 2nd job is commission only and that isn't consistent and hard to budget and plan. <br />

I have no problem leaving the house and finding another home. It's just that we would pay the same amt elsewhere and not get as much as we have here. My husband and I are not good at budgeting/finances so I want to know, based on our circumstances, what is the best financial decision? We just learned that my husband has some significant commissions coming in a couple of months; enough to pay the past due amount. Don;t know if it could happen before the foreclosure or not -- and not sure that's the best thing to do! We are upside down on the house and will never make a profit on the house. We have been here 12 years now and it needs fixed up and in need of some repair.<br />

Although a cat is said to have nine lives, a distressed borrower has but two or three. Although each scenario is different, the fact you keep running into difficulties suggests you cannot afford to keep that house.  Perhaps its time to articulate and pursue new short and long term goals.]]></description>
