            <description><![CDATA[ They are to sell the house on the county courthouse steps on June 4.  Can I try to short-sale before at this point?  Do I have to contact a realator to do a short-sale?  (I think that is a yes but just checking)<br />

If it goes to the foreclosure date how long will I have to move out?  <br />
<br />
They are stating they will review more paperwork for underwriting so trying to continue to get more paperwork together for reveiw before June 4 ?<br />

            <description><![CDATA[ ells Fargo denied our last request for a loan modification and set a sale date for June 4, they<br />

 denied stated could not prove residency on the house.  My father's home has my telephone number on the home phone bc I did Medical Transcription there qhile helping to look after my mother and since it was my business I listed the services in my name. His   namr was left on is house that he doesnt live in annymore.  Is there any chance Wells Fargo is going to let him keep this house and work out a load modification. The load was on an afjustable arm and the paymet is now exceeding the contract amt of 1057.  payment is now up to 1231.<br />

Any help would be appreciate,  Cant catch up,,,, We don't know what to do byt we dont[ want to lose this house]]></description>

            <description><![CDATA[ I've read a large number of articles where people are asking the lender to produce the original paperwork for the mortgages, and it's stopping the banks, at least for a while.  Basically you are telling the bank to prove that you are in fact the lender who holds my mortgage.  My question is, I know that this can't stop the bank forever, but if the judge rules against the bank, or they are forced to withdraw the suit, how can they proceed any further?]]></description>

            <description><![CDATA[ Hello,<br />
<br />
We live in Indiana and I found out at the end of March that my home has been filed for foreclosure. We have not been able to make a payment for about 9 mos. My husband called to see if they can work with us somehow because we cannot pay the past due amount. This is not the first time we have had trouble. We have had a bankruptcy in the past while here, but kept the house. Then a year later were not able to keep up with the payments so we had a loan modification. Then another year later continued to have financial difficulty and are behind once again. <br />
<br />
So my question is: what can I expect from this? What is the likely hood of them working with us? How fast can they foreclose on us?  Could it be sooner than normal because of our past trouble?<br />
<br />
I am just sick because I don't know how to prepare for the near future. <br />

Recently in Mobile, AL a company was fined $250,000 and ordered to pay restitution for fixing foreclosure auctions. The company owner and his partner both plead guilty and face up to six months in jail in additon to the fines and restitution.<br />

            <title>Which Way Is the Best Way Out? - Missouri (5 replies)</title>

            <description><![CDATA[ Okay,<br />

We're in the state of Missouri, and we've been struggling with an upside down house for four years. We were determined to stick it out, but then we received the letter about property taxes and the normal threat of &quot;either pay or we take.&quot; That was the last straw for us, and we just stop doing everything. Now, we have a home that five months behind in mortgage payment(and we're still getting phone calls), and the threat of the property tax people is that by the end of June, they will foreclose on our house.<br />
<br />
But wait! If we don't pay our two mortgages from HSBC, they're going to foreclose too! That's coming from two-three different directions!! <br />
<br />
So we just moved out. The calls are still coming, and as far as we know, the county has every intention of doing what they've said, but it could happen in June or later. Wait, there's more:<br />
<br />
We are now working on a plan to pay back our past personal taxes, which isn't much, but the only way we'll be able to pay it is if we get out from under this home, so there's the other reason for walking away.<br />
<br />
We looked into bankruptcy,- we want the Chapt 7, and we know we still have the personal tax = but so far, almost every attorney has only provided enough pieces to make you excited about it, leaving little things out here and there. We went to an attorney that told us that foreclosure and bankruptcy were the same thing, which we found out wasn't true (We just learned that the attorney was part of a firm that going through lawsuits all across the country because they take your money and don't file!). <br />
<br />
We also were told that if the house foreclosed, and they took it - who? the county or the mortgage? - they would then be responsible for all the property tax, but I'm not sure if that's right either, and it's going to cost around 300.00 just find out!<br />
<br />
So now, we're just trying to figure out when to tell the mortgage company and/or the County that we haven't paid either of them, and see what happens. We figure if we can get out of the line of fire long enough to destress and save up, we can then file for bankruptcy if and when either parties start itching to check into what money we &quot;dont'&quot; have, and decide to try and garnish wages. <br />
We're still trying to figure out if it's better to let them foreclose  and then file bankruptcy after, so as to catch any other fallback from the procedure. If this is the case, then the only thing we have to worry about is having it in hand before and/or if someone decides to try a garnish.<br />
<br />
That's the story. We don't know whether to call and tell the mortgage company or just let it fly. We don't know whether to call the county and direct them to the mortgage company, or just keep our fingers crossed that we'll have enough money to do a bankruptcy. Either way we will wind up waiting 8-10 years to get our credit back to &quot;good&quot;, but make no mistake - at our age, and this economy, and the fact that our kids are grown and wouldn't want to ever live in this state...we won't be buying another house, and that's a fact!<br />

If anyone can give us the straight scoop on this, it would be so much appreciated. If someone is here from Missouri and has insight, that too would be great.<br />

Green Tree Servicing has begun the foreclosure process on on this property. They seem very interested in completing a Deed in Lieu instead of foreclosure. Why is that? Is there any real benefit for me to take the Deed in Lieu instead of foreclosing? Will it actually do less damage to my credit? Is it worth settling my second mortgage (as much as $6k) to complete the Deed in Lieu?<br />

Assume I ask for a favor from Green Tree in exchange for providing a Deed in Lieu. What can I ask for? What's the best possible outcome that Green Tree can provide in order to minimize the damage to my credit?<br />

            <title>How Much Fraud Exists in Florida (3 replies)</title>

            <description><![CDATA[ The Florida Supreme Court is currently deciding whether a plaintiff should be able to voluntarily dismiss a pending lawsuit when a defendant is seeking sanctions for fraud on the court.  I’ve been following the arguments and the briefs being filed, and I’m struck by what I just read from The Mortgage Bankers Association.<br />
<br />
In the first issue of its brief, MBA argues (stay with me, it’s important, so I’m quoting it):<br />
<br />
    Initiating radical change in the applications of Rule 1.420 and Rule 1.540(b) could convert the mortgage debacle, from which Florida is slowly recovering, into a widespread financial crisis. …  [Not allowing a plaintiff to voluntarily dismiss a lawsuit in the face of a claim for sanctions for fraud on the court] would impact general credit and lending practices, just as the fragile real estate finance industry begins to rebound from a severe economic downturn.  If the [banks] face potential revocation of voluntary dismissals, lending practices in Florida could come to a grinding halt.  The threat of sanctions would force lenders either to prosecute technically infirm cases, rather than cure defects in a new proceeding, or risk being prohibited from re-filing, after faulty documents have been corrected.  Such unduly harsh procedural impediments would deprive lenders of the ability to collect their loans or apply collateral to satisfy these obligations.  Without the ability to collect on defaulted notes, lenders would be unable to make new loans and refinance indebtedness in this State.  The economic impact could be devastating to the State of Florida.<br />
<br />
Let me get this straight.  According to the MBA, not allowing banks to dismiss foreclosure cases when a defendant is claiming “fraud on the court” would cause a “widespread financial crisis,” cause lending to come to a “grinding halt,” prevent lenders from collecting their loans or making new loans, and be “devastating” to Florida.<br />
<br />
Those are some incredibly strong statements, so much so that I can’t help but wonder …<br />
<br />
If those would be the consequences, just how pervasive must the foreclosure fraud be?<br />
<br />
Think about it.  If the fraud isn’t pervasive, there’s no way the Florida Supreme Court’s ruling (no matter which way it rules) could possibly have the consequences the MBA is suggesting.   The fact that the MBA is this concerned should speak volumes about the magnitude of foreclosure fraud in Florida.<br />
<br />
If you doubt the existence or pervasiveness of foreclosure fraud in Florida, don’t listen to me or a consumer advocate.  Simply read the MBA’s own brief.]]></description>

If the sale doesn't go through we are going to do a deed in lieu of foreclosure and that date will be June 25th. <br />

The bank told me that would like us to continue making our payments, but if we can't they understand and we will more than like not be foreclosed on while our house is for sale. <br />

            <title>Renting Home with Sale Date of May 7th (4 replies)</title>

            <description><![CDATA[ I am so stressed right now! Returned home from work with a Notice of Trustee's Sale for May 7th. Called, the Landlord and she acted as if she didn't know...but stated she'd send a notice to vacate on June 30th. Landlord states to pay her May and June rent. But if the home is in pre-foreclosure should I pay her rent? And she has a security deposit...wants to schedule a walk through??? Even if we destroyed the house (which we never would), what are her losses? I know she is going to walk with our deposit. Here's my question...shouldn't we pay the new owner?             <description><![CDATA[ In Jan of 2012, BoA accepted my offer on a forclosure. Since then, problem after problem has popped up. I am stuck on the problem now.<br />
<br />
The house was built in 2005 and sold in 2006. It looks like BoA did not do a title check and there are two liens on the property. One is for 5 million and the other for 500k. The property appraised for like 140k. They can't seem to find the info on the title insurance, the lawyers that preform everything are no longer in business. I am pretty sure if you have a mortgage, you have to have title insurance or they will not finance the property, right??? As anyone ran into this before or do you know where I should start looking the title insurance records? If so, any info will be appreciated.  I call BoA every day and I get nowhere with the people on the phones, they have no idea what I am talking about. <br />

            <description><![CDATA[ I have been served that my house is in foreclosure (sort of), since i never gave my name, however the guy still left the note on my doorsteps (not sure what the legal procedure for serving is).<br />
<br />
My question is, what happens if my i owe the bank X for the house but it sells for X-Y during foreclosure (which it surely will). Will the lender ask me to pay them Y?<br />
<br />
Also, i have 30 days to respond... are there any questions I can ask so I can stall the process until i figure out what to do?<br />

            <description><![CDATA[ So what happens now??? I understand that since the bank  was the only bidder that it now goes to their Real Estate Owned department but really what does this mean to me???<br />

I still live here and have 2 roommates that I rent to as well. My real question is how long before the bank forces me out of the house? On the notice of sale document the bank sent me it said that the purchaser at the auction had 20 days to stennattle on the property and then the tenants would have 90 days before they had to leave. Since the bank is tecnically the winner at the auction do they/ will they still go to a settlement in 20 days? How fast does the bank actually retake the property from me? Am I looking at days, weeks, months or what?<br />

I live in Maryland and the mortgage lender is PNC. <br />

Mortgage foreclosure scams have surged nearly 60 percent this year following the launch of several federal programs, the Homeownership Preservation Foundation (HPF) announced. <br />

“Regretfully, every new government initiative spawns a slew of foreclosure avoidance scams, often from the same cast of characters doing business under various names to avoid easy detection and identification,” said Colleen Hernandez, CEO of HPF. <br />
<br />
Hernandez added that most of these scams involve individuals purporting to offer foreclosure prevention assistance that trained HPF counselors provide at no cost. <br />
<br />
“HPF’s trained counselors can provide distressed homeowners with all the assistance they need to understand their options, prepare the necessary paperwork, and negotiate with their mortgage servicers,” she said. “Anyone facing foreclosure should never pay upfront fees for these services.” <br />
<br />
Sometimes, scams are not so obvious. <br />
<br />
Hernandez warned that some organizations are using HPF’s logo and brand in their promotional materials even though they are not affiliated with the organization. <br />
<br />
“The only way distressed homeowners can be certain they are dealing with a trained HPF counselor is by calling 888-995-HOPE,” said Hernandez. <br />
<br />
The $25 billion mortgage settlement, expansions with HAMP and HARP, and the OCC’s Independent Foreclosure Review are all examples of potential relief offered through the government. <br />
<br />

I’ve read many good articles,  one from Abigail Field, explaining why the 25 billion dollar settlement between the Attorneys General and the TBTF banks was a terrible deal for consumers and our country as a whole.  For me, though, there is one simple, obvious way to prove this settlement was and is a complete and collosal failure.  Simply compare the rate at which banks were filing new foreclosure lawsuits and prosecuting existing foreclosure cases before the settlement to the rates now, after the settlement.<br />
<br />
Before the AG settlement was announced, banks were very slow to prosecute existing foreclosure cases and loathe to file new cases.  To illustrate, it seems crazy to say so now, but My Law Firm went nearly a year without a single bank setting a hearing on a motion for summary judgment.  Think about that for a minute … nearly a year without a single summary judgment hearing (in any of my cases).  I like to think that’s partly a product of the banks and their lawyers not wanting to face me in court, but certainly there was more to it than that.  Banks were hesitant to prosecute foreclosure cases without a settlement and release from the AGs.<br />
<br />
After the AG settlement was announced, banks accelerated the foreclosure process, both in terms of new cases and the prosecution of existing cases.  How do I measure the difference?  Well, the banks are now proceeding at rates faster than I’ve seen in the four-plus years I’ve been defending Florida homeowners.  If banks were a snail before the AG settlement, they’re now a jackrabbit.  That’s not to say foreclosure cases cannot be defended any more – they can.  But the approach and overall dynamic of foreclosure defense has changed drastically in recent weeks.<br />
<br />
As for the key question, i.e. whether the AG settlement was helpful to homeowners, ask yourself this – “if the AG settlement was helpful, why are banks foreclosing faster now, after the settlement, than they were before?”<br />
<br />
The settlement should have discouraged abusive practices in the banking industry.  Instead, the TBTF banks accepted their slap on the wrist, took their release from the AGs, and began their corrupt and fraudulent practices anew, full speed ahead.<br />
<br />
Imagine a professional bank robber stealing $500 million from 20 different banks over a 10-year period, then being “punished” by having to pay back $500,000 with no criminal penalty and no jail time.  Wouldn’t the bank robber, after that punishment, go right back to robbing banks?  That’s what’s happening here with the AG settlement, only, in America, the bank robber would never escape punishment while the TBTF banks always get off scot-free.  That may sound harsh, but, again:<br />
