            <description><![CDATA[ My aunt owed 108,000.00 on her home when she died. She refinanced on the home shorlty before her death. her monthly payments were over 900. Her bank has less than 1000 in it now. I would like the bank to take the home back. the money she left to her child is for him alone. not to make payments on the house. I do not want a realtor that I do not know to list the home...nor do I want to sign any documents with realtors or anyone else that would cause me to be legally connected to the home. If the home forecloses...what will be the process?...how will I be affected as the administrator of the estate? As the administrator of the estate...I am only held accountable to a certain degree. I stopped making mortgage payments on the home when the account began to dwindle at the advice of my lawyer. I refuse to use my money to pay for anything. I don't know why the bank just doesn't take the home back like my lawyer recommended that they do. My lawyer wanted me to list the home with a friend of hers recently. i  do not trust it though. I want to feel comfortable when selling the home. I am not moved by pressure from others to sell the home. With back mortgage payements due, closing fees and a slow real estate market...it is no guarantee that  anything monetary will come out of the sell of the home. When a bank takes back its property and sells a home, will the heir of that estate receive anything in return or  is it a done deal? I wonder do I need another lawyer to assist with this process. My lawyer does not wish to assist with the home now that I do not wish for her real estate friend to list it. It seems that the agent would have benefited more than the heir of the estate if i signed to have the home listed. Please shoot back with some insightful answers to my questions all who know the ropes. the property is in georgia state.]]></description>

            <description><![CDATA[ Hello all, I have 5 rentals in Mississippi. 4 of the 5 have ARM's and are upside down. <br />

The arm's are out of control, the property taxes keep going up, the repairs are eating me alive and November/December are historicaly bad months for collection. <br />
<br />
All that to say this, I am thinking of giving them back. I have lost over 20k the last 3 years and can't keep this up.  My wife and I both work 2 jobs just to stay afloat.<br />
<br />
What am I looking at? Will they come after the difference or just write it off? Can they come after my personal residence which has very little equity? The 5th rental? What about taxes? How is my mid 700 credit rating going to look with 4 foreclosures? How many times is my phone going to ring and for how long? How much advance notice should I give the tenants? Sorry for all of the questions. <br />

            <description><![CDATA[ we are in the middle of a &quot;hardship&quot; workover with wells fargo; the next step will probably be short sale. i have a friend that keeps telling us to short sale the house on our own, now, without waiting for the banks go ahead. i know that we have the right to do this but my concern is that we'll find a buyer &amp; the bank won't accept it. i know banks are more willing today to accept short sales rather than foreclose but i sort of feel like i have more security if THEY tell US to do it. <br />

I got behind on my mortgage because my credit card bill was up to 24%.  They have now got me down to 2% so that % is locked in on my cc card.<br />
<br />
I have now found myself around 3 months late on my mortgage.<br />
I have rented out my home, but have used the renters $ to get ahead on other things.<br />
<br />
(by the way I am a San Diego resident)<br />
<br />
I wrote into my mortgage company and said I am renting out the home and I am not living <br />
in it.  Not knowing I have to &quot;live/reside&quot; in the home for them to remodify the loan.  I tried<br />
backpeddling and told them I do live in the home and rent out the rooms, they didn't go for it.<br />
<br />
So my next step it to speak to HUD.  Now my question to you is, what do I tell them.<br />
I live in the home, I don't live in the home, etc..  It's like you tell the truth and things backfire<br />
on me.  <br />
<br />
The renters pay me $2,000 a month (which is right around what the mortgage is).<br />
I am upside down on my home and I put $100,000 down for it, and don't want to lose<br />
that.<br />
I want to re-modify my load where I can get locked into a good % and make progess on paying<br />
off my home.  I have a load where the % can go up and down.<br />

Again, stupid me when I wrote my hardship letter that I said I don't live in my home (which I don't)<br />
but, then they said &quot;send us a utility bill under your name&quot;, but all the bills are under the renters name.]]></description>

            <description><![CDATA[ Today my home was on the auction block,  I went to see but it was to cold, I told myself whats the point. I got home, the phone rang and it was the Fanny Mae guy that I called before to find out what I could do.  He said he called B of A and they said they did not own the note and had no record of my account #.  Ok so I called B of A and the guy I talked to said my auction date wasn't till 12/14/09. I informed him that all the notices I have say 11/12/09 even on realtytrac site. At the auction they even called out my address. He said well things change. Ok well no one informed me.  I asked him to produce the note, that I wanted a copy and he proceeded to offer me a program called collapse. I do have to do a partial reinstatement of 1,753.58,good faith pymts of 161.00 for 3 months at 8.44 %, after 3 months of good faith pymts. it will roll over to 3.49% and pymts. of 172.00 to 180.00. The Fanny Mae guy (Koby) gave me a # to  call, he said it was the U S Treasury, they could tell me who owns the note.  Something doesn't seem right here, any thoughts?  Could they tell me one thing on the phone, get my money and change there mind?  OR is this my miracle! My husband wants the deal, he don't want to live with my mama! I have a home, in NY, in the foreclosure process.  A tenant is renting out the home.  The auction is scheduled for this monday.  A rep from Fannie Mae Bank visited the tenant today and alledgedly told him the bank has recently taken title and he must leave.  I advised him not to leave unless he has an eviction notice from the sheriff to vacate premises.  <br />
My goals:<br />
-  I at least want the tenant to be able to stay at the house through the holidays<br />
-  I would like to see the bank pay the tenant cash, I've heard $2500 has been given from the bank to the tenant to vacate premises.  (Unfortunately, the bank may have paid my former tenant who left in Sept 2009, I have no way of knowing if this occurred)<br />

Our California home which is valued anywhere from 150-200K less than purchase price is no longer affordable. We are reviewing the financial analysis forms from the banks and can complete most of the paperwork. However, we do have a problem with one of the forms, the dreaded 4506-T. Tax forms for the last 3 years were never filed (never let friends handle taxes). Yes that was stupid on our part, but what is done is done. Anybody know the consequences? The way I see it is that the home just might go to foreclosure.]]></description>

Home in Vancouver, WA. I co-own home, he lives in the home, I live in Vegas.<br />
He stopped making payments months ago, and I can't afford to make both. We are both on title and the first mortgage. I took out a Home equity line of credit (Bank of America) for our mutual benefit, but it is solely in my name, secured by a deed of trust on the home. <br />
Home = approx $180-$200k, 1st = $133k, HELOC = $47k.<br />
<br />
My question: if the home gets foreclosed on, and the line of credit doesn't get full paid off, am I still obligated to that debt? (I own another home in Seattle and one in Vegas, so I can't really just declare bankruptcy.)<br />
I am attempting to get sole ownership of the Vancouver house, so that I can rehab it and get it rented out until there is some equity to sell it, but the co-owner lives there and won't sign it over to me - I am hiring an attorney, but thinking it might just be better to let it go, if the line of credit debt goes away with any foreclosure - as we're 7 months behind already, and my credit is pretty much shot already.<br />

            <description><![CDATA[ Friend retired, got hit hard in stock market and can no longer manage current California home- given high mortgage, high taxes, insurance, maintance, etc.  However, she is of the generation that saved money, never missed a payment and can actually afford to pay cash for a slightly lesser home, which would run about half current home, taxes, etc.  She doesn't care much about credit scores as she pays cash for everything or doesn't buy it.  She has little moral quam here, as Country Wide recently acquired her loan and seemingly wanted to destroy the capital structure of this nation single handedly. She is having a hard time imagining it, but is there really a problem with walking?]]></description>

            <description><![CDATA[ friend has a house valued about 300k<br />
owes about that much on mortgage after taking 150 out of home and refinancing it a few years back when it was worth 425k<br />
he wants to just hand the keys to the bank and walk,<br />
does not care about his credit has another house<br />
he and wife both work<br />
pays almost 3k a month for mortgage and taxes/insurance etc<br />
is he making a mistake beside ruining his credit for the next 7 years<br />

            <title>How can we force the lender to record the foreclosure? (no replies)</title>

            <description><![CDATA[ Big screwup. Normally, according to a title officer we spoke with- after the Trustee's Sales in which the property doesn't sell the trustee ( Recontrust ) is supposed to prepare a Trustee's Deed to send to the title company for recording with the County to return title to the lender. Our original foreclosure date was October 8, 2009- as set by Countrywide. Four sale attenpts later, the house ( now vandalized ) has not been sold. We moved out September 2007and have not paid since then - it is amazing that it took 12 months to even set the original date, and here we are November 2009 ! Still not recorded as foreclosed.<br />

The City Code Enforcement is sending me citations and fines on the property for vandalism done after we left. I get the notices at my new address via mail.The fines will go up to 100k, according to the City's Order issued Sept. 2009 to me. The Code manger said that eventually there will be a tax lien placed on the property and a judicial foreclosure. When ever that will be ? - I wonder. <br />

I have been given the run-around by B of A, Countrywide and Reconrtrust for six months- since the City began getting on my case. TALKED TO SO MANY PEOPLE, E-MAILED, WROTE, FAXED ! A lawyer said it would cost $6 just to file suit.  I have two complaints pending with the Comptroller of the Currency as of now. <br />

Any ideas on how to force the foreclosure here in Riverside , CA to be recorded? Ideas welcome ! I plan on picketing in front of the B of A on the day after Thanksgiving if this is not resolved .]]></description>

            <description><![CDATA[ I have a comercial mort.170k owed paid 240k 12 yrs ago 2001 apprasial was 500k/no late payments ever,no back taxes/2nds/or leins on title,2008 self employed my business lost money (like most) the are starting foreclouser on the property,my credit took a hit but it never effected my ability to keep this mort current,is there anything i can do,im sure a new lender is totally out of the question,and this loan is not up for renewal for 4 years? and my current bank will not work with me after 7 years perfect payment history,thanks for any feed back.]]></description>

            <description><![CDATA[ We inheirted a house that we were going to let go to forclosure since it still had 112k on the mortgage. No after careful study of the legal description of the mortgage, the mortgage only has 5 acre's that house is not even on. The house is on a seperate connecting lot that is not attached to the mortgage. So if they foreclose and there is no house what happens???]]></description>
