Well, that's kind of a difficult question. Generally, if situations change and an existing loan has been in place for a year, I'd think it would be difficult to consider it fraud.

If you had to recently refinance and you can't afford the payments without your wife, the question arises about "How did you qualify for the loan?". Not trying to be harsh, it's just the "not considered fraud" part makes me wonder about motivation.
