Without knowing the specifics of the plan, I can't say exactly how it may come back to bite. Suffice it to say if you are promoting "windfall" along with bankruptcy protection, there's a bit of a conflict there.

I don't believe it would bite the defendant, but a plan promoted as promoting a borrower "windfall" that had any relationship to BK proceedings is certainly going to fall in an area best described as grey.
