Hello! I'm trying to understand what I can do. I have a second lienholder somewhere. However, the people the servicer has told me that owns 2nd lien doesn't own. And they've yet to do any assignment or anything with this lien. But I know the orginating loan company doesn't own. Nor does the people they say that owned the note. Because of what my former job did I've ended up Losing job. And having to file bankruptcy. A chapter 13. And now servicer has filed claim with bankruptcy trustee showing original deed no assignment or anything. How can they rightfully collect on something they can't show ownership to?
I know I'm right on this...As prior to my bankruptcy the 2nd tried to foreclose...And they stopped it because of the requests I put into the agent they hired and phoned the so called owners of my note. The whole reason I initially fell behind is because the job I had said they did have the right to sell discounted mortgages on behalf of CMMC/Citifinanical. I only found out they didn't after they took one investor for $80,000 for notes face value of $300-500k
But yet there's no ramifications for them. What's the use of taking a job if they can get by with lying? As most states are a right to work state unemployment office didn't seemed concerned. I literally asked if they had the right to sell notes before I took job with them. They said yes and did this for 2 1/2 years before they ripped investor off. It's truly disheartening what collection agencies can get by with. I was one of their top performers always number 1 or 2 with a national player. Even protected client more than they did. If a file was placed in error boss would tell me to just collect it any which way I could. Even to where in order to verify I'd call client directly to verify if debtor was telling the truth. When they were file was called from client immediately. The horror stories I could tell.
However, with the experience I have it's been hard finding a job. I'm good with notesales/shortsales. And alot of knowledge that most people don't have. But lack a proper funder for purchasing my own properties now my credit is shot. Any advice or help?? I'm trying not to relocate from St.Louis to Charlotte NC for another opportunity I've been given.
