Yes -- get an offer, in writing, first. Then contact the lender (loss mitigation department, not collections) and talk to them about a short sale. YES -- you should disclose the situation to potential buyers. I don't work in the Orlando area, so I won't be soliciting business by telling you to get an agent -- one who understands short sales. List the property on the open market and get your best offer. If you get an offer that covers everything but the prepayment penalty the lender still has to approve it -- but I cannot imagine a lender letting that kill a deal.
