I handle HOA foreclosures for a law firm in Southern California. We represent over 700 HOA's, and I do not know one that cannot legally file suit for past due assessments, even after foreclosure by a senior lienholder. The authority lies in the wording of the CC&Rs of your association. Most provide that delinquent assessments will become a lien against the property as well as the personal obligation of the record owner. The real key to determine whether the association will come after you probably lies in their history and the amount of the arrearage.
