The property is owned by the bank until after the auction. Anytime before then is ok. After the auction then the Bank has to serve Notice to Quit which is at least 30 days before the Summons and Complaint is filed, which is another 2 weeks before a court date, then another 2-4 weeks that judge gives the tenant to move.
