Foreclosure Sale Next Week..Help!

I am emailing you to file a complaint against one of the Housing Counselors with NID Housing Counseling at 2000 Snapfinger Woods, Decatur, GA # 770-322-6007. We met with Tim Spears towards the end of January to see what we could do to keep our home. We had filed bankruptcy due to loss of income and falling behind on our mortgage. After meeting with Mr. Spears he assured us that because we were better stable financially he would help us obtain a loan modification with our mortgage co. Saxon Mortgage. He directed us to get our bankruptcy dismissed and then we could proceed. We gave him authorization to speak with Saxon on this same day, gave him all of our financial paperwork including hardship letter, 1099s, paystubs, etc. and paid in full the charges the housing agency charges $499 based on our income to act as a third-party negotiator. We constantly received letters from both Saxon and their attorneys in which we forwarded to Mr. Spears. He assured us he was on top of everything. Some of the letters received from the mortgage company's attorneys were notice of an auction to sale our home on the first Tuesday in April, being April 1, 2008. Mr. Spears again assured us that everything was being taken care of and we would not lose our home. We spoke with Mr. Spears frequently and he always assured us that we woulnd't lose our home. Then on March 13, 2008, Mr. Spears called my wife Antwionette Cobey on her cell phone and stated that our loan modification was approved. He told her he had to go out of town on a family emergency (death in his family) and that he wanted to let us know before he left so that if Saxon contacted us we would agree to the modification and could go from there. Well a week had gone by and still we hadn't heard from Saxon so we contacted Mr. Spears. According to his receptionist he'd just gotten back into town and would call us back. My wife called him again and he assured her that we should be receiving the loan modification docs any day. I called Mr. Spears again and he said he had a call into a Mr. Preston Brown who had our docs and is taking care of the modification, we would not lose our home. Well on Monday, March 24th my wife called Mr. Spears and he again said the docs were being taken care of by Mr. Preston Brown with Saxon and he gave her Mr. Brown's telephone extension. When my wife called the extension she could never get through. Finally she spoke with a representative by the name of Loretta at Saxon's Loss Mitigation Dept. and Loretta informed her that Saxon never received any docs. She state that her notes read that Mr. Spear called on that same day and asked if they received our request to modify the loan. The notes read that the rep told him no and to fax in the docs as our the sale on our home is scheduled for the following week. Mr. Spears told her he faxed them but it was to an incorrect fax number. She gave Mr. Spears the correct # and he hung up. Loretta also stated that in their notes the last time anyone from Saxon spoke to Mr. Spears was on February 21st. We could not believe this. We then called Mr. Spears and put him on a conference call with Loretta at Saxon. She basicallly said that the only thing she could do was verbally take our financial info. and see if they could postpone the sell of our home. Mr. Spears told Loretta that we had $2500 to put down towards our modification and she said she had to speak with her manager. We were on hold with Saxon when Loretta said that her manager was with another customer but would see what she could do. We hung up with Saxon and told Mr. Spears what Saxon told us about not receiving docs from him, the times they spoke with him and etc. Mr. Spears denied everything. He wouldn't even let my wife finish speaking when trying to talk to him. He put all the blame on Saxon. Now as of today, we have been unable to get a hold of Mr. Spears. We left messages at his office and on his phone and still he hasn't returned our calls. We spoke with managment at Saxon and they said that there's nothing we can do to
We are asking that you look into this. Mr. Spears is not to be trusted. For all we know, he's trying to buy our home through a short sale. We have no family here in Georgia and have no where to go, thanks to Mr. Spears.
