My lender filed for foreclosure, but stopped the proceeding because I answered the summons with some facts about my closing within the 20-days..
1. I never got a copy of my closing papers, what I thought I was purchasing for was different after veiwing the county records.
2. There was no Notary, bank representative from the lender (Chase), or witnesses to my signing at the closing, just me, a friend of mine, and the mortgage broker. Yet on the paperwork filed for the forclosure showed a notary stamped and signed, and 3 witness signitures.
3. I filed for a dismissal but withdrew until i heard more from the lender, or the forelosure to come to court. This would give me time to rent the property, and form a new agreement with the lender or a short sale.
3. Now the lender is seeking to reassign the property to their own fianace company, for $1.00. and file a dimissal for the first foreclosure filed with the cOMPLAINT 2 (MISSING DOCUMENTS CAN'T BE FOUND, AND WOULD LIKE FOR THE COURTS TO PROCEED WITH THE FORECLOSURE WITHOUT THEM.) LIKE I SAID I ANSWERED AND WAS WAITING FOR A RESPONSE. THE ONLY RESPONSE AFTER 4 MONTHS, WAS THE RESIGNMENT.
WHAT CAN I DUE, IS TBIS LEGAL, DO I HAVE A LEG TO STAND ON? OR WHATARE THEY REALLY UP TO NOW?
