Eviction law varies somewhat from state-to-state. Typically in most if not all jurisdictions the hold-over defaulted owner must be given a 3-day Notice to vacate. If he doesn't ... the new owner must then start normal eviction proceedings ... taking from a few weeks to a few months to complete! It seems very, very odd that the Sheriff is already involved without this course of action not having taken place! Are you sure he didn't receive any of the above legal notices already?
