Stalling or Stopping Foreclosure?

Posted by MikeG on October 19, 2008 at 16:52:57:

We are currently in foreclosure on our home located in Rhode Island and are desperately seeking information on how best we should proceed to delay or stop the sale of our home in auction. Below is some information regarding our situation:
- Currently have missed 5 monthly payments on mortgage.
- Recieved notice of default from Countyrwide financials attourney on Sept 25th
- Attourney's request for our response NLT OCt 25th.
- Recieved Notice of Sale/Auction scheduled Dec 11th.
- We have contacted Countyrwide many times tyring to work out loan or modify without any help.
- We live in Rhode Island (Non- Judicial State)

I am looking for some help or suggestions on how best to proceed with delaying and or stopping the auction/sale of our home. Do we respond by Oct 25th to the lawyer and if so what should we respond with?

We also are considering filing for BK relief and would like to know what the best timing on this would be to be the most effective in holding off the auction date. Also we would like to ask the attourney or bank to "Produce the Note" which I feel they will not be able to do so, but being non judicial I feel they will just ignore my requests unless I choose to hire an attourney and fight them in court. I am so confused as you can see by my post! Any suggestions would be greatly appreciated...We are running out of time! Lastly has anyone heard of Neil F. Garfield and his website dedicated to fighting foreclosures?
