Perhaps the seller realizes they will get at 1099 for the mortgage relief and have to pay taxes on it.

Why not ask the bank to take a Deed-in-lieu from the owner and then sell you the property at the short sale price.

As I remember WA has a 30 day Notice of Default and then 121 days of Notice of Sale and then 30 days later the sale can be held...so you are in for a long wait.

I'd opt fot the deed-in-lieu and see what happens.
