A mortgage is contract with numerous terms and conditions. Paying the monthly payment is just one of those obligations.

The real question is was the lien removed within 30 days specified in the notice of default? If not , then the lender is just exercising their right as written in the contract. You should probably seek legal council to see what your options are. I would also strongly consider going back to HRA and discussing with them and perhaps try and get them to make a written statement to the lender that the lien was a mistake, etc. Also, call the lender and start talking to people about the fact that the lien was removed (and be willing to provide documentation). Mortgage companies are huges machines and it may have never been recorded in your file that the lien was removed (even if you were a bit past the 30 days).

In the end, this is a business relationship. It has nothing to do with "being fair", what your martial status is, how many kids you have, etc.

You need to seek out what your real options are from here, select the best course of action and proceed.
