Thanks for responding! We don't have a problem affording the home, BUT we don't have the money to fix the problems that are here currently.

With the mold in the house, it's making my health and my daughter's health go down the tubes FAST! Therefore, we would like to get out of the house, ASAP. I feel as if the inspectors breached there contractual obligation to us, yes... do you think we really could have a case against them? Especially since it's been almost a year now? What route should I be taking with this? (I guess that's my main question)

Now, as for the sale of the home for FMV/short sale, would the mortgage company be able to come after us for funds not paid (home currently worth $234K, paid $295K 11mths ago)? How does that all work out? Is this basically the same as foreclosure? (sorry for all the questions, but I'm not educated on the options, I'm trying to research all of them before stepping forward)

I'll look into the mold situation with the insurance company to see if there is something we can do that way, but it's our health that's most important right now. We need to get out, like yesterday!
