The answer to the summons is a pleading in which you deny or accept the
charges against you. I have included a sample one in my website at
www. that you can personalize and use.
Generally you have 20 days to submit your answer after you have been
served with the summons. Depending on your state laws and rules of civil
procedures, (check www.foreclosurelaw.org/), your hearing will be
scheduled by the lender's attorney after they submit a Motion for Final
Judgment (if there is an answer from you) or a Motion for Summary
Judgment (if there is no answer from you).
At the hearing, it's been my experience that if you ask the judge for more
time to sell your home, the judge will likely give you an additional 30 days
or so before the home is scheduled to be sold at auction.
