There are several cases wher the foreclosure has been stopped because the forclosing party could not produce the documents.
One in Ohio that I remember and one in San Diego that I recall.
Talk with your attorney and ask thim to research.
No documents...No Foreclosure...seems to be the way the courts are looking at it.
