Julio, couple of questions for you please. I bought a property at foreclosure sale. Its a case thats been going on since 2001. In and out of foreclosure. In 2005 the lender negotiated with the owner to reinstate the mortgage at a higher payment. but also at the same time the lender left their right to reinstate the judgment if the defendant defaulted. well the defendant defaulted and they started foreclosure proceeedings again. the defendant tried to file bankruptcy but it was dismissed. the day of the auction the defendant emailed a contract for purchase to the lender and the lender's lawfirm. the lender and the lender's lawfirm denied the supposed contract, and proceeded with the auction. i bought the property and of course now the defendant has objected to sale. Ive seen his documents in the file: contract, loan commitment, short appraisal, invoice for appraisal. all signed by the defendant, but not the buyer or even notarized.
a hearing has been set for later this month.
ok my questions for you are: will the judge decide at the hearing to deny objection to sale or will he take several weeks to decide? The defendant has counsel, Do i need a lawyer even though im not really a party in the suit? ive talked to the lawfirm representing the lender and they of course are going to fight any ojbection to sale. any advice would be appreciated.
