Ernie,

Unfortunately I haven't been exposed to a situation like the one you
describe; however, extrapolating my past experiences and applying them
to this one, I could say that,

1) it's very common that judges decide at the hearing the outcome of the
case unless there is something very unclear and another document(s)
need to be inserted in the case records or so; then another hearing could
be re-scheduled to decide on the case. So, in the situation you present,
it's very likely that the case will be decided at the hearing since the
lender's attorney will do everything possible to make it happen. It's
possible that the homeowner's attorney is an extraordinary attorney and
has a very valid legal defense beyond the documents you mention.
Everything is possible.

2) I don't see why you would need an attorney; why spend $$ on a
lawsuit in which you are not part of? You already have an attorney
working on your interest and that's the lender's attorney.

I hope this helps,

Julio Martinez-Clark
