If a 1099 is issued it should work the same regardless of D-I-L or shortsale. You are right in there being less of a hassle in doing the former. At least from a selling standpoint.
Of course, the bank has to accept the D-I-L. And there could be conditions for doing so.
At this point I would pursue all options that I have.
