What state is the subject property in? I assume this is the residence for your parents. Is your state one with community property?
All of this should be reviewed by an attorney who handles estates and this type of law. The money that you spend for a consultation should save you a lot of money and make all things clear. Be sure that you go to him/her with a list of questions. You may want to consider taping the conversation (if allowed) so that you can review the attorney's responses to your questions. He could also outline for you the order of what things should be completed.
Being in California (San Diego) I have a wonderful attorney that I recommend. I also consult with people in these matters. The meeting with me is to get ready to see the attorney. I can ask questions that you will need to ask at that meeting.
