DIL in Michigan

My husband and I have an opportunity to relocate to TX and we will not and are not willing to do a short sale. Half our subdivision is already in foreclosure and the few homes that are for sale have been for sale since we have been in our house (2yrs). We also would not be able to afford any costs associated with trying to sell our house. We contacted a real estate attorney who wants a retainer of about $1300 to negotiate a DIL for us. We are already behind on our mortgage and we need every cent we have to leave the state. Is this something we necessarily need an attorney to do? I know that we would need to make sure we are not liable for balances or fees. We would also rather put that money toward filing bankruptcy. What about our taxes? Would that be included in the short sale or in a bankruptcy? Any responses appreciated.
