Might be a little of both. According to the various guides it does state that West Vrginia is a no deficiency state. But typically these charts go into no detail. A clarification in "Stop Foreclosure Now" by Lloyd Segal adds this caveat:
"After a non-judicial foreclosure sale, deficiency actions are not permitted and there are no rights of redemption."
Furthermore it says, "Foreclosures of single family residences are commonly non-judicial in West Virginia."
So it would seems that unless your situation is the rare judicial foreclosure you have nothing to worry about.
Oh, I'd get a second legal opinion.
