how long can he go without making a payment

My ex husband kept our house after our divorce, but was unable to refinance to get my name off the mortgage. Now he hasnt made a payment in almost 1 year, but the bank (Wells Fargo) still hasnt set a sale date. I know he has tried two or three times and has been approved for a modification, but he never followed through with the agreement. How long can he stay without making a payment? The home is in MN and since my name is also on the mortgage, this has seriously hurt my credit.
