Forclosed with sale date set
Posted by Elizabeth M on November 29, 2008 at 07:29:32: Hello! We are in California and a sale date has been set for mid Dec 2008 and we just rec'd this. Our lender, Option One, which was bought out by another comp.,are American Home Mortgage Servicing, (are they a debt collector?)negotiating loan modifications says they have put the forclosure on hold and want us to send in $500 for processing fees for the modification (meaning, loan reduction & lower monthly payments) to continue with their attorneys. This is no guarantee that the modification will go through, but it will give us at least a stall to stay through hopefully Xmas. In California, how long after sale or sale date do we have to be out of the property?? There were other companies wanting $3500 (supposedly a retainer fee for attorneys) for they were not related directly with my original lender so I have gone with the AHMSI. Huge questions I know? I'm concerned we may have to be out before Xmas which leaves little time. In California, what is the timing we have from Sale Date Set to be out, and or if house is sold @ auction how much time do we have to be out?? Thank you. Elizabeth
