Yes, loss mitigators main purpose is to MINIMIZE losses. Its hard to believe by their actions, but its true.
If the lender id fully indemnified, they have no right to a DJ. You bring up an interesting question as to whether the insurer will have a claim for a DJ.
It would be a very interesting trial to say the least.
